These Terms of Service govern your use of Pocai. By using the service, you enter into a binding agreement with the developer. Please read these terms carefully.
By accessing or using Pocai's services — including the website, API, console, and all related tools — you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use the service. Your continued use after any updates constitutes acceptance of the revised terms.
You must be at least 13 years of age to use Pocai. By creating an account, you represent that you meet this age requirement. Accounts found to belong to users under 13 will be permanently deleted. If you are under 18, a parent or legal guardian must review and agree to these Terms on your behalf before you use the service. In certain EU member states, users aged 13–15 require verifiable parental or guardian consent under GDPR Article 8 before their personal data may be processed — users in those jurisdictions must obtain documented parental authorization prior to registration.
You are responsible for maintaining the confidentiality of your login credentials and API keys. You agree to provide accurate, current, and complete information during registration. Pocai uses password-based and OAuth authentication — you are responsible for keeping your email and connected accounts secure. Notify us immediately of any unauthorized access.
API access is subject to rate limits that may vary based on usage patterns. You must not attempt to circumvent rate limits, share API keys with third parties, or use the API for any illegal purpose. API keys are personal credentials — treat them like passwords. Pocai reserves the right to revoke API access without notice for terms violations or abuse.
Pocai operates on a Pay-As-You-Go model. You purchase credits that are consumed based on API usage. Credits do not expire but are non-refundable except where required by law. Please review our Pricing page for current rates.
You may not use Pocai to generate, distribute, or facilitate harmful content. Prohibited content includes but is not limited to: hate speech, harassment, threats, sexually explicit material involving minors, doxxing, spam, phishing, malware, or any content that violates applicable laws. Pocai may monitor API usage for compliance and will terminate accounts engaged in prohibited activities.
Pocai, its name, logo, models, and API are the intellectual property of the developer. You retain ownership of any content you submit to the API. By using the API, you grant Pocai a limited license to process your content solely for the purpose of providing the service. Pocai does not use your content to train or improve models unless you explicitly opt in.
Pocai relies on third-party services to operate. These include Supabase (authentication, database, email delivery), Cloudflare (edge network, DDoS protection), and hCaptcha (bot protection). Each service operates under its own terms and privacy policy. Pocai is not responsible for the actions or policies of these third-party providers. See our Privacy Policy for more information.
Pocai reserves the right to suspend or terminate your account at any time for violation of these terms, abuse of the service, or any activity deemed harmful to the service or its users. You may delete your account at any time via Console Settings. Upon termination, your right to use the service ceases immediately. Any remaining credits at the time of termination for cause may be forfeited.
Pocai is provided 'as is' and 'as available' without warranties of any kind, either express or implied, to the maximum extent permitted by applicable law. The service is offered on a best-effort basis by an independent developer as a personal project. Pocai does not warrant that the service will be uninterrupted, error-free, or secure. AI model outputs may contain inaccuracies — you are solely responsible for verifying any results before relying on them.
To the fullest extent permitted by applicable law, Pocai and its developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. This includes, without limitation, damages for loss of profits, data, or goodwill. In jurisdictions that do not allow the exclusion of certain warranties or limitations of liability, Pocai's liability shall be limited to the maximum extent permitted by law.
Pocai may update these terms at any time. Material changes will be communicated via the website, email, or through the console. The effective date reflects the most recent revision. Continued use of the service after an update constitutes acceptance of the revised terms. If you do not agree to the updated terms, you must stop using the service and delete your account.
These Terms are governed by the laws of the Republic of Turkey, without regard to its conflict-of-law principles. Any dispute arising from or related to these Terms or your use of Pocai shall be subject to the exclusive jurisdiction of the competent courts of Turkey. If you reside in a jurisdiction with mandatory consumer protection laws — including EU consumer law or Turkish Consumer Protection Law (No. 6502) — those statutory rights remain unaffected by this clause. The parties agree to first attempt to resolve any dispute informally by contacting trypocai@proton.me within 30 days before initiating any formal legal proceedings.
